No. There are 3 groups that are automatically exempt from this requirement: churches, organizations with less than $5,000 gross receipts, and affiliates of nonprofits that are covered by group exemption. But many churches still choose to obtain 501(c)(3) status for a variety of reasons. If you’re starting any other type of tax exempt organization, you’ll need to apply for tax exempt status. We’ve helped with all three versions of the IRS forms for this process and would be happy to complete the paperwork for you.

Yes, although donations will not be considered tax-exempt until you receive your determination letter. If you get your 501c3 status from the IRS, donations received (properly) after you’ve incorporated will likely be retroactively tax deductible. Keep in mind, you’ll need a separate bank account for the nonprofit. Banks typically require the EIN and articles of incorporation to be filed and approved first. Our sister organization, Fiscal Sponsorship Allies, offers fiscal sponsorship for organizations who are waiting on their 501c3 status so they can start receiving tax deductible donations before obtaining their determination letter. Fiscal sponsorship can also be great for people who want to “try out” their idea for a nonprofit before spending the time and money to get the organization set up as its own nonprofit organization.
No matter if you are starting a nonprofit organization yourself or have someone assist, there are two key costs to keep in mind:
- Each state charges a filing fee to file Articles of Incorporation. Usually this ranges between $25 to $100.
- The IRS charges a filing fee for your application for tax exempt status. Depending on which form is right for your organization, the fee could be as little as $275 or as much as $600.
If you’d like our help, we’re happy to complete the paperwork for you in any state in the US. Our comprehensive startup packages start at $1550, including the filing fees mentioned above.
